Pattern Theft!!

February 17, 2013

Edited — The offending website has finally been shut down! Thanks to everyone for your amazing support and due diligence in getting the word out there and contacting your designer friends! What an amazing crafty community we have and I’m so very thankful for each and every one of you!!!

——————————————————-

So it came to my attention this morning, via Jen who blogs at SewHooked, that Los Angeles Needleworks is swiping the free patterns from many sewing, quilting, crochet, embroidery and knitting designers and selling them on their website. Including several of my patterns.

Recognize my gnomes and hedgehog?

Please do not buy from this website!! Support your hardworking indie pattern designers, and buy patterns directly from the designers.

I just can’t believe the sheer number of patterns this person is claiming to have designed herself! Here is her google+ profile , Her facebook,  andtwitter.Although judging by the terribly translated descriptions, she may not be an actual person, but maybe a front for an overseas jerk?

I’ve heard that her Etsy store and shop facebook page have been taken down, but as of 7:30pm PST the website is still up and adding new patterns.

My husband, rife with anger wrote the following letter to the domain and site hosting providers:

To: support@wildwestdomains.com, support@stablehost.com

Re: Copyright Violation – Losangelesneedlework.com

Hello,

It’s come to our attention that one of your customers is currently running a website under the URL of losangelesneedlework.com.  Through this site they are selling patterns for download that are being pulled from various other websites without the owners permission.

These patterns are being posted for sale WITHOUT PERMISSION, WITHOUT CREDIT TO THE ORIGINAL DESIGNER, AND MOREOVER WITHOUT COMPENSATION.

Primary example I’ll refer to is the pattern designed by my wife Sonja Callaghan of Artisania.ca.

Here is the link to her original pattern “Gnomeling and Fancy Mushroom” that was posted up under copyright in 2008:

https://artisania.wordpress.com/free-patterns/

And here is the link for a “Gnome With Mushroom House Paper Piecing Pattern Quilt Block” currently up on the Los Angeles Needlework site:

http://www.losangelesneedlework.com/2013/sewing-patterns/paper-piecing-quilt-blocks/gnome-with-mushroom-house-paper-piecing-pattern-quilt-block
Gnome With Mushroom House

The primary issue at hand is that not only are they in effect STEALING the pattern outright (image & all) and then SELLING it on their site, when this has been available for FREE on the Artisania site for 5 YEARS.

Artisania is receiving no credit, payment or any type of compensation for this offering, and has never been contacted by, or granted permission to, the Los Angeles Needlework website to use the pattern. Here are two more listings of Sonja’s which are being sold by Los Angeles Needlework:

I request that you immediately notify the infringer of this notice and inform them of their duty to remove the infringing material immediately, and notify them to cease any further posting of infringing material to your server in the future.

Please also be advised that law requires you, as a service provider, to remove or disable access to the infringing materials upon receiving this notice. Under US law a service provider, such as yourself, enjoys immunity from a copyright lawsuit provided that you act with deliberate speed to investigate and rectify ongoing copyright infringement. If service providers do not investigate and remove or disable the infringing material this immunity is lost. Therefore, in order for you to remain immune from a copyright infringement action you will need to investigate and ultimately remove or otherwise disable the infringing material from your servers with all due speed should the direct infringer, your client, not comply immediately.

I am providing this notice in good faith and with the reasonable belief that rights my company owns are being infringed. Under penalty of perjury I certify that the information contained in the notification is both true and accurate, and I have the authority to act on behalf of the owner of the copyright(s) involved.

Should you wish to discuss this with me please contact me directly.

Respectfully,

Vince Callaghan

Please, if you recognize any of the patterns, please notify the designers so they can also take action against this blatant fraud.

If you’re a designer affected by this copyright infringement, start writing to paypal, the domain host website, and anyone else you can think of who can help stop this site.

Here is another designer who’s trying to do something about it.

Thanks for your help and support!

Yes, how awful! Lucky your hubs is a lawyer, right? He sounds like a great one 🙂

I’ve posted about this on both my blog and facebook page! Shame on them! I’m sorry this happened to you and everyone else affected…

this is terrible! i hope you and the others can get this site closed down for good

  5. February 17, 2013 10:41 pm

I’ve tweeted this for you. Hope it gets resolved quicky and this person packs up and goes away due to the social media outcry!

  6. February 17, 2013 11:23 pm

    I won’t buy anything from them…..

  7. February 18, 2013 12:36 am

Sorry for this situation. She must stop immediately.
I have seen she sells free patterns from other designers, too. I haven’t seen mine patterns on her site till now, but look at the prices! It is a shame.

Dreadful – I hope you succeed in having them closed down for good.

I recognised the Dresden Plate Bag as a free tutorial from the Quality Time Blog and notified the blogger. Shocking!

This is so sad !! I’ve run across sites (including ebay) that steal patterns and offer them for sale. If I run across one (especially if it’s free elsewhere). I hope you can get this resolved quickly. Good Luck !!

This is just awful ~ I’ve heard about this happening to other people as well (tho not from this site). Just hope that it gets settled quickly and this person gets in big trouble.

  12. February 18, 2013 6:12 am

I am sorry. This kind of thing is sooooo frustrating. I went through a similar situation with another website stealing translations I had done and claiming them as their own.

  13. February 18, 2013 6:21 am

Thank you for sharing with us. We love you art work and we always enjoy reading your blog. It is horrible for them to do such a thing! No self-respect at all. I have write to my quilt quild and some quilted friends across the country about this matter.

I saw you posting about this yesterday on IG and Flickr, what a shocker. I am truly appalled

This is terrible, and pretty much a byproduct of the entitlement society we live in. People feel they are entitled to other people’s stuff.
Artisania my dear, “you didn’t build that!” lol just kidding.
I applaud and adore your hard work and creations. I am so glad you discovered this.
I have found from time to time other things like this.
    People have NO SHAME now.
God Bless you. I for one will always support you

I wrote this on Flickr, too. Report this to Google (http://www.google.co.uk/dmca.html#notification and http://support.google.com/bin/static.py?hl=en-GB&ts=1114905&page=ts.cs). I had done this for another website and they removed it from their search engine. Note that I didn’t send anything by post so must have used the second link.

  17. February 18, 2013 7:54 am

What a crock. I hope it gets shut down quickly. And I really hope they didn’t make any money.

  18. February 18, 2013 8:33 am

The support of the community has been overwhelming. I must have had 25 people alert me to this theft. I only hope their hosting company complies.

Chances are they will give them a backup and they will move to a new hosting company, then the cycle begins again.

However, Here’s hoping this discourages them.

Great post, well done! This person needs to know that what she’s doing isn’t cool. Keep sharing everyone! 😀

Unsurprisingly, two of my patterns are on there. Going to send an email in now.

  21. February 18, 2013 10:26 am

Thanks for letting us know. I think it is terrible for someone to steel others work. You designers work so hard on your work. It’s not right. I hope it can be stopped!

Way to go Mr. Callaghan! The last place I would want to be is on the receiving end of *that* note. Thank you both for standing up for indie artists’ rights! (And shame on the people who believe they can walk all over them with no consequences).

I think I love your hubby. THANK HIM from the bottom of my heart for what he did on behalf of community! ❤

I understand your rage and my condolences.

But take heart that your effort paid off.

    The domain account is suspended.

That doesn’t mean this scum won’t pop up somewhere else with a new domain and start over again.

Watermark your copywrite across your photos. You can add copywrite and theft blurb on your patterns but a copy/paste thief like this will ignore it anyway.

  30. February 18, 2013 8:57 pm

http://losangelesneedlework.com/cgi-sys/suspendedpage.cgi “This Account Has Been Suspended” Awesome!! Good Work.

So, the google+ profile pic is actually taken from a Russian? Croatian? website. I reverse image searched it and its an advert for esoteric something or other. Ridiculous.

So glad the site is down, now we all need to be on the lookout for another site that s/he tries to create.

Hi Sonja, I found another possible theft of your art. Maybe I’m wrong, but I though I’d send this along and let you decide. This lady is selling bags with your little fox design. http://www.etsy.com/shop/SmallTownThread
